For the seizure to be valid, it must meet constitutional standards. A Notice of Seizure must be served upon the individual from whom the currency was seized. The notice must contain specific information about what was seized and identify what laws were found to be violated in justification of the seizure.
When the government has seized your money, you must file a Petition for Remission or Mitigation within 30 days, otherwise, you automatically forfeit your money to the government. When filing a petition for relief with the government, you will have to prove the source of your funds and that there was a legitimate use of the funds. You will also have the opportunity to demonstrate any mitigating facts or circumstances surrounding the seizure.
